ISLAMABAD, Jul 28 (NNI): The Islamabad High Court (IHC) has directed the Federal Investigation Agency (FIA) to investigate the authenticity of the ‘controversial’ Facebook posts shared by a judge hearing the Toshakhana case against the PTI chief.
IHC Chief Justice Aamer Farooq issued the directives while hearing a set of petitions filed by the former prime minister seeking transfer of his case from Additional Sessions Judge Humayun Dilawar, challenging maintainability of the Toshakhana case and summoning of record from the Election Commission of Pakistan in the case initiated after the PTI chief was found guilty of not declaring the state gifts in assets declaration.
The petitions come as the trial court has summoned him to record his statement under Section 342 of the Criminal Procedure Code before it concludes the case.
The IHC CJ remarked that the former premier’s plea against the admissibility of the case is “the second round of litigation on inter alia subject of limitation and authority of person filing complaint on behalf of the Election Commission of Pakistan, as earlier, this Court [IHC] had… referred to learned trial court for decision afresh.”
The PTI chief wanted to transfer his case to another court due to the alleged bias of the trial court judge Dilawar and in this regard he also shared details of the judge’s alleged Facebook posts regarding the Toshakhana case.
During the hearing, the chief justice was informed that the judge had denied the posts. He issued directives to “remit the issue of the authenticity of the posts to the Cyber Crime Wing of Federal Investigation Agency, Islamabad, with the direction to submit the report positively before next date of hearing.” He later adjourned the case.
